Review & Description

What should we do with teenagers who commit crimes? Are they children whose offenses are the result of immaturity and circumstances, or are they in fact criminals?

“Adult time for adult crime” has been the justice system’s mantra for the last twenty years. But locking up so many young people puts a strain on state budgets—and ironically, the evidence suggests it ultimately increases crime.

In this bold book, two leading scholars in law and adolescent development offer a comprehensive and pragmatic way forward. They argue that juvenile justice should be grounded in the best available psychological science, which shows that adolescence is a distinctive state of cognitive and emotional development. Although adolescents are not children, they are also not fully responsible adults.

Elizabeth Scott and Laurence Steinberg outline a new developmental model of juvenile justice that recognizes adolescents’ immaturity but also holds them accountable. Developmentally based laws and policies would make it possible for young people who have committed crimes to grow into responsible adults, rather than career criminals, and would lighten the present burden on the legal and prison systems. In the end, this model would better serve the interests of justice, and it would also be less wasteful of money and lives than the harsh and ineffective policies of the last generation.

Review & Description

The story of how innocent photographs taken by a mother of her child became the heart of a wrenching legal battle--an unforgettable book that "restores the truth of a family's life" (Sally Mann, photographer).

Ten years ago, amateur photographer and school bus driver Cynthia Stewart dropped off eleven rolls of film at a drugstore near her home in Ohio. The rolls contained photographs of her eight-year-old daughter Nora, including two of the child in the shower--photos that would cause the county prosecutor to arrest Cynthia, take her away in handcuffs, threaten to remove her daughter from her home, and charge her with crimes that carried the possibility of sixteen years in prison.

The disturbing case would ultimately attract national attention--including stories in USA Today and on NPR--and supporters including the famed photographer Sally Mann, Katha Pollitt, and the ACLU.

Written by poet Lynn Powell, a neighbor of Cynthia Stewart's, this riveting and beautifully told story plumbs the perfect storm of events and people that threatened a loving family in a small American town. Framing Innocence features a determined prosecutor; a fundamentalist Christian anti-porn crusader who is appointed as Cynthia's daughter's guardian; the local attorneys for whom the case would become a crucible; and the many neighbors--friends and strangers, Republican and Democrat-- who come together to fight for sanity and for justice for Cynthia and her family.

Review & Description

With the divorce rate above 50 percent and climbing, more and more parents are faced with difficult situations involving their children. This book is designed to let parents know their legal rights and to help them understand the court system.

Most parents think that once a decree for support has been ordered, that all is over. However, often that is just the beginning. Getting the support that was mandated, in the amount that was stated, in the manner that was determined necessary and in the time indicated are often major issues that must be continually confronted for the good of the children.

In addition to covering all of the basics, Your Right to Child Custody, Visitation and Support also examines current hot topics such as parental kidnapping, child support enforcement and when one of the parents is in the armed forces. Easy-to-use, blank tear-out forms makes this new edition a must for every person who has children and has gone through or is contemplating a divorce.

Review & Description

A long-awaited history that promises to dramatically change our understanding of race in America, What Comes Naturally traces the origins, spread, and demise of miscegenation laws in the United States--laws that banned interracial marriage and sex, most often between whites and members of other races. Peggy Pascoe demonstrates how these laws were enacted and applied not just in the South but throughout most of the country, in the West, the North, and the Midwest. Beginning in the Reconstruction era, when the term miscegenation first was coined, she traces the creation of a racial hierarchy that bolstered white supremacy and banned the marriage of Whites to Chinese, Japanese, Filipinos, and American Indians as well as the marriage of Whites to Blacks. She ends not simply with the landmark 1967 case of Loving v. Virginia, in which the Supreme Court finally struck down miscegenation laws throughout the country, but looks at the implications of ideas of colorblindness that replaced them. What Comes Naturally is both accessible to the general reader and informative to the specialist, a rare feat for an original work of history based on archival research.

by Carlos A. Ball
Release Date: May 14, 2012

Buy new: $35.00

Review & Description

In 1975, California courts stripped a lesbian mother of her custody rights because she was living openly with another woman. Twenty years later, the Virginia Supreme Court did the same thing to another lesbian mother. In ordering that children be separated from their mothers, these courts ruled that it was not possible for a woman to be both a good parent and a lesbian.

The Right to be Parents is the first book to provide a detailed history of how LGBT parents have turned to the courts to protect and defend their relationships with their children. Carlos A. Ball chronicles the stories of LGBT parents who, in seeking to gain legal recognition of and protection for their relationships with their children, have fundamentally changed how American law defines and regulates parenthood. Each chapter contains riveting human stories of determination and perseverance as LGBT parents challenge the widely-held view that having a same-sexual orientation, or that being a transsexual, renders individuals incapable of being good parents.

To this day, some courts are still not able to look beyond sexual orientation and gender identity in order to fairly apply legal principles in cases involving LGBT parents and their children. Yet on the whole, Ball’s stories are of progress and transformation: as a result of these pioneering LGBT parent litigants, the law is increasingly recognizing the wide diversity in American familial structures. The Right to be Parents explores why and how that has come to be.

by Helen Stalford

Review & Description

This book examines in detail the status of children in the EU. Drawing on a range of disciplinary perspectives, including the sociology of childhood and human rights discourse, it offers a critical analysis of the legal and policy framework underpinning EU children's rights across a range of areas, including family law, immigration and child protection. Traditionally children's rights at this level have been articulated primarily in the context of the free movement of persons provisions, inevitably restricting entitlement to migrant children of EU nationality. In the past decade, however, innovative interpretations of Community law by the ECJ, coupled with important constitutional developments, have prompted the institutions to develop a much more robust children's rights agenda. This culminated in the Commission's launch, in July 2006, of a comprehensive EU strategy to promote and safeguard the rights of the child as well as the incorporation of a range of children's rights provisions into the proposed Lisbon Treaty. The book therefore comes at a pivotal point in the history of EU children's rights, providing a detailed and critical overview of a range of substantive areas, and making an important contribution to international children's rights studies.

4.3 out of 5 stars(3)

Review & Description

On a spring day in 1993, Nancy Abrams helped her daughter dress for day care, packed her lunch, and said good-bye. Next she drove to court, where she learned that in the eyes of the law she was nothing more than “a biological stranger” to the child she helped bring into the world and raise. That was the last time she would see her daughter or hear her voice for five years.
The Other Mother begins as Abrams and her female lover decide to start a family together. With giddy anticipation, they search for a sperm donor, shop for baby clothes and crib, and attend childbirth classes. But despite their high hopes, the relationship begins to fall apart, and they separate when their daughter is a toddler. Problems between the two intensify until, shortly before her daughter’s fifth birthday, Abrams loses custody.
In unprecedented depth, Abrams’s compelling narrative examines the social, legal, and political implications of gay and lesbian parenting. Her haunting memoir asks the question, “What makes a mother?” It is a question that biological parents, co-parents, adoptive parents, step-parents, and divorced parents must each answer in their own way. In telling one woman’s story, The Other Mother makes a solid case for legal protections, including marriage, for lesbian and gay families.

Review & Description

Taken into Custody' exposes the greatest and most destructive civil rights abuse in America today. Family courts and Soviet-style bureaucracies trample basic civil liberties, entering homes uninvited and taking away people's children at will, then throwing the parents into jail without any form of due process, much less a trial. No parent, no child, no family in America is safe. The legal industry does not want you to hear this story. Radical feminists, bar associations, and social work bureaucracies have colluded to suppress this information. Even pro-family" groups and civil libertarians look the other way.
